
Beautiful finishing, a view from the balcony, or a good price can be captivating. However, before signing a preliminary agreement, you must absolutely check three key elements in the land and mortgage register.
Three key sections and elements of the land and mortgage register
- Section III – Rights, claims, and restrictions: This is the place where personal easements (e.g., life estate), warnings about enforcement proceedings, or claims from other preliminary agreements may be hidden.
- Section IV – Mortgage: Check whether the property does not serve as security for debts, which requires obtaining a balance certificate and consent for the removal of the mortgage.
- Section I-O and II – Compliance of the factual state: Ensure that the square footage and appurtenances correspond to reality, and in Section II, verify the sole owner or all co-owners.
When browsing the land and mortgage register number in the electronic system, pay special attention to entries marked with a red font or the letter W symbol. They indicate that a new application has been submitted to the court, which has not yet been entered into the content of the register.
